When there are the judiciary are all to often over lenient in their approach (when compared with other life threatening offences).</p> <p>If we had a law of Strict Liability, the victim would at least be in a better position to receive civil compensation, although it would not affect the criminal prosecution (quite rightly, people would still be considered innocent until found guilty) and it could also make people think more carefully before getting behind the wheel. </p> http://citycyclingedinburgh.info/bbpress/topic.php?id=10876#post-121139 Thu, 08 Aug 2013 11:52:23 +0000 Wilmington's Cow 121139@http://citycyclingedinburgh.info/bbpress/ <p>The husband of a colleague of my wife was hit by a driver in East Lothian who, it was found, should have been wearing glasses. And wasn't. He was turning into Muirfield, there was CCTV, but apparently only caught the cyclist 'flying through the air'. He suffered a bad head injury (was helmeted) and has trouble concentrating now (he's a partner in a law firm, it's a bit of a drawback not having concentration).
