The law on this very specifically excludes cyclists, otherwise obviously the cyclist in the video would not be doing it.</p> <p>There's a possible argument that if you're on the phone cycling in a completely straight line in a cycle lane and get hit from behind that your use of a phone might contribute to a charge of furious cycling or whatever, but I think that's frankly absurd in this case.</p> <p>(Personally I wouldn't be riding on the phone, but we have made a lot of laws and in fairness this isn't one of them)</p> <p>Surely the police will charge the motorcyclist over this, especially since he has apparently claimed on the linked forum that he was teaching a lesson... </p> http://citycyclingedinburgh.info/bbpress/topic.php?id=12858#post-154525 Sat, 24 May 2014 11:27:59 +0000 Focus 154525@http://citycyclingedinburgh.info/bbpress/ <p>Nothing excuses the motorcylist's actions ('making' a lane which didn't exist), and he was the sole cause of the collision, but the cyclist certainly shouldn't be on the phone, let alone doing it somewhere like the Mall (not that anywhere else would be acceptable either).</p> <p>The cyclist showed poor judgement in flouting the phone laws and the biker showed bad manners, inconsideration for safety, and lied to the police about the true nature of what happened. Slap on the wrist and fine for phone use for the cyclist and dangerous driving action against the biker should be the outcome. Both are clearly guilty from video evidence alone.</p> <p><strong>Be sure to watch the full version</strong>, and you'll see that the police officer takes everything the biker says as gospel without allowing the cyclist to put his case forward. To her, it's all about the phone use.
