<description>&#60;p&#62;There isn't an outcry because &#34;everyone&#34; does it. Pretty much. I even saw a woman barrelling round a corner the other day with her mobile held up in front of her face talking into it, apparently having a video conversation.

<description>&#60;p&#62;Well they could do with cracking down on mobile driving. I see it literally every day, everywhere I go. If such large numbers of drivers were instead swugging from bottles of whisky while driving there would be a huge outcry, surely. Yet mobile driving is often more dangerous than drink driving, the level of distraction is so great.

<description>&#60;p&#62;@tk I believe the call has to be made using a recognised hands-free kit to be legal.&#60;br /&#62;
  On a technicality, Siri with a phone lying on a seat does not meet that requirement).&#60;br /&#62;
(To my mind, texting manually with a handsfree kit is more dangerous. Talking on a hands free is also dangerous)&#60;br /&#62;
  The other explanation police will have to disprove is if the accused says that it was their passenger that used the phone.

<description>&#60;p&#62;I do wonder how they will be able to tell whether the phone was hand held at the time. For instance I have used Siri on an iPhone to send a text to say I'm running late - no hands and less distraction than a call. It's one button on the steering wheel then speaking &#34;text xxxx I'm running late and will be with you in 5 minutes&#34; the message is read back and the. All I have to say is &#34;send&#34;.   If the police checked my phone, they would not be able to differentiate whether ifs removed it from the cradle and was typing away while driving or whether I'd sent the message with voice recognition.
