Any Scottish councillor can be an unpaid non-executive director of a council owned public transport company, as long as they do not take part in any council discussions or votes directly related to that company. See Section 74(3) of the Transport Act 1985.</p> <p>This would certainly make the job of being convenor of the Transport and Environment Committee a bit tricky, but probably not impossible.</p> <p>Failure to comply with this requirement is an offence, punishable by a fine.</p> <p>Scottish Ministers can issue a letter of dispensation, excepting individuals and groups from this requirement.
