&#60;p&#62;Police Scotland sent a couple of bobbies round to view some dashcam footage I had of a ned pulling wheelies on an unregistered trail bike through traffic on Craiglockhart Avenue.  They didn't take a copy away but did ask me to hang on to it myself in case they needed it to support a possible prosecution.  So it looks like they will use video taken by members of the public.&#60;/p&#62;
&#60;p&#62;I can understand why they might not want to plug someone else's USB stick in to one of their machines.  They are a notorious vector for malware.  The company I work for now, and the one before that, has disabled the use of USB ports by data devices (USB sticks, portable hard drives, even mobile phones) on all their machines, requiring senior management sign-off before a USB port could be enabled for a critical, one-time data exchange purpose.&#60;/p&#62;
&#60;p&#62;I can also very well believe that access to YouTube from their network is blocked as a matter of general policy.  They would by no means be unique in that.&#60;/p&#62;
&#60;p&#62;I suspect that, though their interest might be piqued by footage posted on Youtube, they can't use it as it stands.  They'd have to retrieve the original footage and gather robust information about how it was collected before it could be used as evidence.  More likely, regarding an incident such as the Ferry Road assault, they would use any footage obtained to try to identify one or more of the culprits, and use that to progress their enquiries to the point where the PF would be prepared to take it to court.&#60;/p&#62;
&#60;p&#62;That's not to say that &#34;technical reasons&#34; &#60;em&#62;aren't&#60;/em&#62; sometimes used as a cover for &#34;can't be @rsed&#34;, of course.

&#60;p&#62;A few years ago, I made this point on CEC: &#60;/p&#62;
&#60;p&#62;If it was a murder and the only piece of evidence was filmed footage of the killer in the act, police would use it. Therefore, the argument that helmet cam footage doesn't can't up in court is nonsense.&#60;/p&#62;
&#60;p&#62;And, therefore, it was nothing more than an excuse to avoid enforcing laws that are intended to protect cyclists. &#60;/p&#62;
&#60;p&#62;After &#34;operation close pass&#34; was brought in, the police &#34;suddenly realised&#34; they could use footage to prosecute. &#60;/p&#62;
&#60;p&#62;And here we are with another concrete example of the police being willing to use helmet cam footage.&#60;/p&#62;
&#60;p&#62;Maybe someone should ask the police why they peddled these lies for so many years.

May 22 : Police in Drylaw are appealing for witnesses to an assault which occurred about 5.30pm, Tuesday 8th May 2018. A cyclist on the Ferry Road walkway near to Ainslie Park Leisure Centre had items thrown at him and was pushed off his bike by a group of children.&#60;br /&#62;
We are keen to speak with anyone who may have been in the area around this time or saw the group of children. We are particularly interested in helmet cam or similar footage and would ask cycle path users to check your footage and contact us if you were nearby at the time.&#60;br /&#62;

&#60;p&#62;The situation I alluded to wasn't hypothetical or made up.&#60;/p&#62;
&#60;p&#62;On Sept 1st I was driven at and swerved into by a motorist. He then braked heavily in a bid to get me to crash into his rear end. When I swerved into the other lane to avoid that, he then swerved over to get me that way.&#60;/p&#62;
&#60;p&#62;I only stayed upright by having very quick bike-handling ability.&#60;/p&#62;
&#60;p&#62;A witness emerged who had taken a photo of the vehicle as they were horrified I had almost been run over by the motorist.&#60;/p&#62;
&#60;p&#62;The police have shown no interest in either speaking to the witness or identifying the driver.&#60;/p&#62;
&#60;p&#62;I would have felt less threatened by someone waving an iron bar about, because I'd have had more options.  You can't disarm someone using a vehicle as a weapon, and its also harder to flee the situation.&#60;/p&#62;
&#60;p&#62;Yet the police would take one type of incident seriously, and ignore the other.

<description>&#60;p&#62;Yes, I suppose that the intent to injure is probably the difference here. A driver deliberately passing too close to a cyclist may think they are trying to persuade the cyclist they do not belong on the road but probably doesn't intend to injure them. In a similar way to a person carrying an iron bar in an intimidating fashion only strays into attempted assault when they start swinging it.&#60;/p&#62;
&#60;p&#62;The frustration which the law fails to recognise is that the driver has a greater risk of causing injury through negligence than the iron bar carrying thug.&#60;/p&#62;
&#60;p&#62;As you say getting the courts to provide appropriate sentencing is completely different matter to a police investigation.

I do think the majority of near misses are due to incompetence rather than malicious forethought and deliberate attempts to hit someone, so not really on point with the iron bar swinging. Not to say it isn't wrong, and the police definitely don't take those seriously, but it's not attempted assault without an intention to assault, and rather is dangerous driving etc (or should be seen as such).

Unless someone can show me a case where a driver deliberately tried to hit a cyclist with their car, did so, caused hospitalisation, and could be identified (noting we're talking about the police here, and not the courts then being lenient), and the police simply didn't bother to investigate.

&#60;p&#62;I am not sure that is what they are saying - most seem to be talking verbal abuse - and as WC notes, that is &#60;em&#62;not&#60;/em&#62; the same thing.&#60;/p&#62;
&#60;p&#62;Your scenario is extremely rare and if it happened as you describe, said cyslist was hospitalised, and the police did not investigate, then I agree that would be scandalous.&#60;/p&#62;

&#60;p&#62;To be honest, idiots in cars verbally (and physically) abuse other car drivers every day - and I imagine that a case of &#34;He said, She said&#34; between car drivers gets the same level of investigation (i.e. pretty much nowt) as a similar in a bike/car verbal altercation would.
