<description>&#60;p&#62;These English judges Magistrates  are laymen,  if look at the guidance on sentencing could see if fits, however it seems to have missed the leaving the scene and nor coming forward, would be surprised if that offense could not have been added, nor if leaving the scene could be considered adverse inference by failing to provide breath or drugs testing. Also who knows may be the cyclist could have lived if had raised alarm quicker. The hit and run and failing to stop failing to provide sample or report to police station. Always wonder if the English system using laymen if robust when the rest of Europe uses professionals, including Scotland, although in Scotland a private prosecution could not be taken (unlikely to be as need permission only 1 in 100 years or something) such as that other case discussed recently.
