Another van blocking the cycle lane at McDonald Road while installing an ANPR camera. Interestingly it’s just overlooking the junction so doesn’t seem to be there for enforcement.

I can advise a 100% refusal rate so far for the Leith Walk 'cycle' lanes for morning cyclists emerging from the Picardy Place hellscape.

If you can survive Leith Street why would you play Toytown Cycle Lanes on your way to work?

In the RSO's there are only 3 categories - carriageway, cycleway, footway. Cyclists are not allowed to cycle on the footway. There is no"shared space". Hence on Leith Street where the "segregated" cycle lane endeth at Greenside Road, the whole area is designated as cycleway - ie can be used by pedestrians and cyclists. This caused furore as pedestrian association assumed this meant that only cyclists could use it.
I wasn't aware of any RSOs for Leith Walk - the first that I saw were the ones for Leith Street. I'm not sure whether they are required for changing pavement use or maybe just where the carriageway space is being changed.

I have walked the bia-pass when motor broke year agos, I have walked worse roads. You also can not walk on airstrips, in peoples gardens natural boundary of property, On some MOD land, some industrial sites, many places, but still the best access in western world. Its gives me bad feeling in england where can barely walk anywhere. The majority of people appear to respect the cycle paths.

I think you are labouring unnecessarily over this.

Pedestrians can walk anywhere except motorways. So it doesn't really matter what the cycle lanes on Leith Walk are designated as. The point is, that the demarcation betwixt cycleway & footway is crap (tactiles that are barely visible, and no demarcation at some of the junctions). It should instead have been an angled kerb, which would have helped to keep the peds off.

Basically, infra should be designed so that it's intuitive for all parties to use - not the case here.

Reply from Gayle @edinhelp (via Direct Message on Twitter:

-------------------
Morning, Just to let your know, I have heard back from the department dealing with this - "The cycle lanes on Leith Walk is a designated area for cyclists to ride within the greater footpath area. This is the only area on the footway where cyclists are permitted to use (other than the road) however it may also be used by pedestrians.Only the cycle lane is shared." Hope that this helps. Thanks, Gayle
-------------------

Lovely. So if someone is walking in the cycle lane, and they don't move / refuse to move when you come along, you technically have to dismount, walk around them, then re-mount.

I also wonder if anyone / any organisation keeps track of "dedicated cycle lanes", and needs to be updated that the cycle lanes on Leith Walk aren't dedicated cycle lanes at all, but are shared use?

I actually have vague recollection now of the bus stop bypasses being RSOed as shared use

This seems like an unnecessary legal step as pedestrians may cross the area anyway, just as they can cross a road

You don’t designate a pedestrian crossing area of a road in a redeterminaton order

Indeed. Council acknowledged this when the university asked if something more appropriate could be put up instead, but insisted that the dismount signs remain.

@gembo - in my discussions with the Council over the MMW closure, they've said that the pedestrian side is not designated as solely a footpath, the full width is a core path (and a redetermination order hasn't been made to make it a footpath).

So, yet again, the Meadows may be different!

@crowriver - Yup: "And finally on pavements, remember that on segregated cycle tracks the pedestrian side remains a footway, so if you cycle into the pedestrian side to pass a pedestrian in the cycle lane you technically commit a pavement cycling offence" - I would assume the same applies on Leith Walk if the cycle track is shared use.

Added complication at the Meadows is that some of those paths are core paths, so you're allowed to cycle on the footway side too. Unless there are TROs saying otherwise, which might well be the case.

Yeah, I'd imagine it's the same here. Though if the whole width of the pavement is shared use, it at least makes things all legal to cycle around pedestrians milling around in the cycle lane.

It'll also be interesting to see if they intend to mark the whole path as shared use or not - surely there needs to be sings at the start and end, and at junctions to say it's shared used? Of course, since there's no signs saying it's a cycle lane other than the bike logo painted on the surface, it's all open to interpretation anyway...

The law is that if it's a space which is split between pedestrians and cycles (like the meadows) rather than shared use, then the non-cycle part is considered a footway, so cycling on it is the same as cycling on the pavement.

I've no idea how that applies if it's shared use, however.
