IIRC that offence dates back to 1835 Highways act and throwing up water & odure from the carriageway when you drove your carriage through it - a level 3 offence with (last time I came across it) a maximum fine of £2500 (most likely when this is a deliberate act- as one example of driver drenching a bus stop queue and posting passenger's video on Youtube....)

Worth noting that all London Buses now have external cameras (contract condition) and most major groups get cameras external & internal as standard now. But act fast - digital data is overwritten every 7 or 14 days.

NB bicycles were recognised as carriages by case law c.1870, and formally in SI in 1882 IIRC. I think 1903 Motor Car Act included defining cars as carriages for the purposes of 1835 HA

"however maybe it is me
I got soaked today while walking, by a car doing the same thing I work outdoors and was in a bright orange storm jacket!"

Yep - with a little observation and awareness of the road conditions and the moving traffic, that could all have been avoided,

That's a curious one.

Most replies on here have involved 'we've looked at the video and talked to the driver'.

got a reply

Thank you for your e-mail regarding the bus driver on the service 1 on 10 August 2011. Lothian Buses has, at its busiest periods, over 500 buses on the road operating in service and we receive very little in the way of negative comments regarding the actions of our drivers when sharing road space with cyclists. Nevertheless, there have been several company based schemes in the recent past designed to enlighten our staff to the dangers that cyclists face on a daily basis. Currently the Managing Director Ian Craig, the Operations Manager and Spokes, the local pro-cycling organisation, are working on another scheme to bring cyclists to the forefront of the driver’s minds. By your report it seems that on this occasion this driver has failed to appreciate the risks involved and may have compromised your health and safety.

Please be aware Lothian Buses take matters of this kind extremely seriously and take the necessary action to try to prevent incidents like this reoccurring. It will be made clear to this member of staff that driving dangerously and risking the health and safety of another human-being will not be tolerated.

On behalf of Lothian Buses I apologise for your experience and I thank you for taking the time to bring this matter to my attention.

email sent.
I went back that way today and you can see the water on the path from (i assume) the buses going by as the puddle is more in the gutter area
so smaller traffic wont get it

however maybe it is me

As I understand it LRT do take complaints seriously these days, they didn't used to, but with the introduction of CCTV cameras it is a lot easier for management to take disciplinary action after complaints.

Yep, could have been dangerous to the point where you could have lost control due to the direct actions of the driver. Particularly when on a reasonably thin and busy road in adverse conditions

Possibly caught on their camera too.

was coming along the shared cycle path in Stenhouse
just passed the bus stop area where the path comes closer to the road (heading away from the gyle after Saughton Road Nth)
No 1 bus in the bus stop waiting to get out
I go past it and on past to just before the part where theres a little pointless loop towards the tram track/old guided busway
At this point the bus goes through a puddle and swamps me with a wave that goes over my head
to say I was livid was an understatement
It took all my control not to get off at the next stop

worth contacting LRT?
