&#60;p&#62;Of course (depending which paper you read) &#34;militant worker&#34; is someone who'd rather be on strike...&#60;/p&#62;
&#60;p&#62;&#60;em&#62;You&#60;/em&#62; sound like someone facing an uncertain future due to an unfortunate accident/incident (I get the impression you wouldn't be being treated any differently if it had been work related). &#60;/p&#62;
&#60;p&#62;Seems clear you WANT to work, have been good at your job and would continue as a useful/experienced member of staff if allowed/encouraged by a better management. &#60;/p&#62;
&#60;p&#62;You seem to be a victim of a style of 'modern'/militant management that might fit with the times 'we are all in together' - but is actually counterproductive. It might put all your fellow workers in fear of their jobs, but an unhappy workforce is unlikely to be a productive one. &#60;/p&#62;
&#60;p&#62;Good luck, perhaps now is the time to list your experiences and 'transferable skills' and look for an employer who would appreciate them.

I was actually dismissed before through sickness.&#60;br /&#62;
They had me bang to rights with the time I had off. however at that point my eye was healed(medically confirmed) so they just decided to sack me as a 'lesson' to other workers.&#60;br /&#62;
unfortunatly as is there way(as my posts have shown) they failed to follow their own procedures,ignored letters etc&#60;br /&#62;
So I won an appeal(after 2.5 months away!) got my job back,back pay etc&#60;br /&#62;
you would think this time they would be following procedure to the letter. they know I know the procedures,but still act like this.&#60;/p&#62;

<description>&#60;p&#62;custard - yikes!  Seriously, you need to get some independent advice.  From what you have said you may well have the foundation for a claim for harassment/bullying.  In addition, the effect of your injury may possibly fall within the definition of disability in the Equality Act 2010 - in which case your employer has to make reasonable adjustments to accommodate you.&#60;/p&#62;
&#60;p&#62;Good luck in dealing with this - I'm disgusted with your union reps.  Honestly, if they can't assist in a case like this then what use are they (stick with the union though as they should provide legal representation if this ever goes to a tribunal, and that really costs a packet).

I did actually contact HR previously regarding my grievance. it was basically being ignored&#60;br /&#62;
they simply replied back stating the dont deal with stage 1 grievances yada yada&#60;br /&#62;
I eventually got things going by contacting a regional manager&#60;br /&#62;
of course now he scowls at me every time he is in the office.....&#60;br /&#62;
no doubt I have been flagged up as a troublemaker&#60;/p&#62;
&#60;p&#62;I'll be chasing up the OH consult&#60;br /&#62;
sadly on reports ATOS(who they use) are very much on the employers side it seems&#60;br /&#62;
The worst is Im covering a full job in the work that needs covered. I have done it before and do it well.&#60;br /&#62;
The managers all happily admit it,then cant seem to grasp the basic concepts regarding workloads. unless you are in the 'gang' of course.&#60;br /&#62;
I asked them in mid November about the staffing for Christams and assumed they would at least bring in the extra staffing they have done in previous years.I was at them every weak and warned them I couldnt do all the work they were piling on.&#60;br /&#62;
So now they have one less staff member in the busiest period of year. madness

<description>&#60;p&#62;custard - as a workplace union rep I find your experience really disappointing.  Is there any way you can bypass your local reps and get full time officials involved?  If not then it might be worth finding a well informed and supportive colleague to attend meetings with you and get them to take notes, so you can focus on the meeting rather than note taking.  &#60;/p&#62;
&#60;p&#62;Make sure you have access to a staff handbook/rulebook or whatever your organisation calls it plus your contract and get to know what you are entitled to.  Ask for everything to do with your case in writing, particularly copies of HR/management notes of meetings.  Crosscheck your own meeting notes with the HR/management notes - dispute any disparities between the two.&#60;/p&#62;
&#60;p&#62;Do not sign or agree to anything in a meeting - it's never a good idea - take some time to reflect on things.&#60;/p&#62;
&#60;p&#62;Please chase up the occupational health referral with the most senior HR person you can find and keep badgering them until it happens, as they can be useful allies in dealing with management (if they are any good).&#60;/p&#62;
&#60;p&#62;I'm sure you probably know/do all of this already - but thought I would mention it just in case.

I had a torn cornea that caused me ongoing issues&#60;br /&#62;
so i have seen 1st hand how useless my union is. I 'won' in the end. luckily there is a forum of fellow workers who helped me massively&#60;br /&#62;
At my last meeting I had 2 union reps! who basically sat like ornaments&#60;br /&#62;
I also raised an issue with the H&#38;amp;S rep(not just affecting me) and wwas told it seems fine. when i raised the issue came earlier the day. I was told they dont work then......&#60;br /&#62;
no doubt when I return to work I shall have another round with them&#60;br /&#62;
I was promised a occupational health referral last time. this never happened&#60;br /&#62;
so I'll need to flag it up again.&#60;/p&#62;
&#60;p&#62;Its annoying as Im working my ass off to try and heal/do my best&#60;br /&#62;
I have paid for physio,sports massage and have taken on a trainer.&#60;br /&#62;
Im at the gym(not now due to the pain) 5 days a week at great cost in sleep/pain to myself!

- Take notes of all meetings with management, with date, time, what was said. Compile into a folder which can give a narrative of what's been happening&#60;br /&#62;
- Ask a union rep, another employee, or a friend to accompany you to any meetings. This is your right and may help with corroboration if any threats of dismissal are made.

However, it might be worth getting them to call in the full time officials, who should know what they are doing and will be able to access some heavy duty employment lawyers (if required) at no cost to yourself.  Depending on your union, you may be able to contact your full-time official directly.&#60;/p&#62;
&#60;p&#62;Please don't try and go it alone, as the odds are stacked in your employers favour.  If your union really is no use then I'd take WC up on his offer of assistance.

I am better at dealing with stuff than they are!&#60;br /&#62;
on my return to work we have a 'return to work meeting'&#60;br /&#62;
(there was big managerial clear out while I was off including dismissals)&#60;br /&#62;
so im with a manager I dont know.&#60;br /&#62;
Im sitting there and he is asking about my rehab plan. there wasnt one,no duty plan,nothing.&#60;br /&#62;
So i cant do my main job but can cover other duties that need covered.&#60;br /&#62;
they then started cutting staffing and giving me more work than they give people normally!&#60;br /&#62;
This ended with me going down a grievance procedure and getting many promises of what would happen.&#60;br /&#62;
admittedly they returned the staffing to normal but nothing else.&#60;br /&#62;
now for Christmas they didn't lay on extra staffing as they always have done(and need!)&#60;br /&#62;
So as i told them what would happen my pain just got worse and worse.&#60;br /&#62;
In real terms I'll most likely getting paid off in one form or another. either by medical retirement(in my 30's!) or dismissal. though their behaviour so far has laid the ground work to fight a dismissal

heavy workloads/understaffing at work meant my pain levels have been creeping up over the last couple of weeks&#60;br /&#62;
got to a point where I could barely get through the day&#60;br /&#62;
taking a few days to hopefully get the pain levels down&#60;br /&#62;
sadly for me I have a completely unsupportive employer and this puts me on course to a 'stage 2' at work on sickness. (stage 1 issued for the accident time off)

Went out today on the bike&#60;br /&#62;
been many months off the road&#60;br /&#62;
still got hand pain on the bike&#60;/p&#62;
&#60;p&#62;full recovery is unlikely at this point.&#60;br /&#62;
I got some tests done and the consultants view was my arm works and I have strength.&#60;br /&#62;
The fact is hurts every day and there is a high possibility of me losing my job,perhaps with medical retirement or simply by being forced out doesn't seem an issue.&#60;br /&#62;
Its a bit annoying as Im really only as capable as I am,through the work I have put in at the gym and the PT I ue.&#60;br /&#62;
perhaps I would have been better sitting back and letting my mobility decline

wasn't really up to lifting it to check it before&#60;/p&#62;
&#60;p&#62;front wheel is out of true,tyres got scrapes on the edges&#60;br /&#62;
its flat so will need to see if its just a puncture&#60;br /&#62;
I cant take the tyre off,so Im going to drop it off at TBW and get them to check it over and true it&#60;br /&#62;
headset feels rough? from the impact or just that im noticing it?&#60;br /&#62;
my new Selle Italia saddle is badly scraped,though held well considering&#60;br /&#62;
nice chip out the paint on the top tube&#60;br /&#62;
grips are scraped&#60;br /&#62;
scrapes on the easton bar and I think it may be flat on one end. by that the ritchey ergo grip seems flat. I cant remove the grip yet so I'll have to leave it for now.&#60;br /&#62;
both brake levers took a good whack. one was popped out,but has popped in&#60;br /&#62;
however both now have a lot of play in the lever pivots&#60;br /&#62;
cant really test the gears properly yet&#60;br /&#62;
front lights are busted up&#60;br /&#62;
my bells scraped ;)&#60;br /&#62;
my main cree lamp still works but the mount is toast.&#60;br /&#62;
I'll look into a mount,or buy another and keep whats left for spares.&#60;br /&#62;
helmets toast obviously&#60;br /&#62;
my Altura jacket seemms okay bar some scraping&#60;br /&#62;
hole in my thick tights at the knee&#60;br /&#62;
camelback mouthpiece bit is gone&#60;br /&#62;
my ipod is gubbed as its dented in at the dock connector&#60;/p&#62;
&#60;p&#62;think thats all&#60;br /&#62;
could have been a lot worse TBH

I passed by yesterday on the bus and it looks like theres already bits of tarmac breaking up&#60;/p&#62;
&#60;p&#62;havent been posting much as whilst my shoulder is healing well.&#60;br /&#62;
I'm getting real pain from my radial nerve.&#60;br /&#62;
its gets worse as the shoulder gets better!&#60;br /&#62;
hoping it just swelling or something pushing on it and it will sort itself out in time.

<description>&#60;p&#62;I checked out the Peffermill potholes this afternoon (Sun, Jan 8th), and the two have been filled.&#60;/p&#62;
&#60;p&#62;The potholes haven't, however, been sealed with cold pour, so I would expect them to be gradually excavated by the usual buses and any freezing weather over the next few weeks.  I took photos of them.&#60;/p&#62;
&#60;p&#62;I also took photos of another developing hole a few metres further towards Craigmillar where the tarmac has cracked around a water main air valve cover.  The foot or so of fill above the air valve chamber has obviously subsided, taking the road with it.

<description>&#60;p&#62;Yes Custard there is a wave of tarmac by the pavement, which was there when I took the photos too.  If anything there is more aggregate spread over the road now. This is on a regular bus route and the buses will be going into the holes, they cause the waves of tarmac too, and further along is the bus-stop where there are more holes to be avoided.

<description>&#60;p&#62;I went past yesterday, 31st December 2011, in the morning and afternoon and it had most definitely not been fixed, if anything it was worse than when I took the photos.  &#60;/p&#62;
&#60;p&#62;The corner off Liberton Road onto the Gilmerton road is also definitely getting worse, and I had a very close encounter with a SUV, which almost took me out literally being a couple of inches off my handlebars, whilst I was avoiding disappearing down one of the numerous craters, sinkholes, and missing or raised utilities covers.  &#60;/p&#62;
&#60;p&#62;All in all the road surfaces in Edinburgh seem to be deteriorating at an alarming rate.  I think that some of the utilities companies should be sued/fined for their appalling repairs after digging up trenches etc in the roads.  I believe in Holland when patching up roads they have to use the same size/colour and mix of aggregate to tar and the roadworks are inspected after they have been done and they have to redo them if they do not come up to standard (allegedly).
