I suppose the point about bollards is that you know that they are on the verge, and therefore will not be in your way when you drive past them. The driver perhaps observed it, dismissed it as "not a thing to worry about" and looked further ahead. Whereas actually a bike moves, is in the carriageway and clearly needs to be manoeuvered around.

Not at all to defend vehicular manslaughter, but I can understand the psychology of the driver - observe ("red shiny thing"), assess ("won't be in my way"), move on. A bicycle is a strange thing to encounter on that road at 4am, perhaps his brain was playing Occam's razor.

I feel that this is sort of misleading too - It's clearly a part of the A1 which allows cyclists on it. He was wearing adequate reflective and lights (although what that means who knows- however we know he was visable at 150-200 yards)

Horrid story. really makes me worry.

????

Surely the question he should have been asked in court was simply, "So do you routinely drive straight into bollards?"

A rather novel excuse. Didn't stop him from running the cyclist over and killing him. Would he have driven into bollards so casually? Also the court debated whether the cyclist should have been on the A1 at 4am...

Driver got a 12 month ban and 200 hours community service.
