    Well I am not sure how easy these things are to measure precisely, well not without medical insurance and going private, with NHS even getting to do basic tests is like getting blood out a stone like other government “benefits” supply feels based more on how well someone whinges, knows mp or the right person rather than an objective measure, could mean a lot of different things.

    When I had a closed head injury in my last year at university in 2000 dropped out from poor concentration, tiredness and headaches things. Not sure if someone necessarily completely recovers. If the driver had insurance and assuming she has no medical insurance as most people in the uk don’t, then for medical purposes would make sense for her to make a claim as otherwise face the whims of the NHS.

    See threads passim about liability and blame.

    As a diver, I've got public liability insurance, and if something went wrong on a dive, I'd expect my buddy to take advantage of this. I'll be doing my best to protect them, and prevent any injury, but if that is the outcome, then that's where the liability insurance kicks in and provides the compensation I couldn't personally provide.

    And yes, the pilot is much more likely to have such insurance than the guilty teenager, although the calculation of contribution is likely to kick in.

    For example (and purely for generic illustration) the insured couldn't have predicted the guilty party's antics so only 40% liable for the collision, the injured party could have mitigated their injuries by prompt physio, -25% of the compensation, etc.
