  3. Yeah, I know, but sometimes the cynicism takes hold. Quick Google suggests killing while using a phone IS seen as serious though.

    Does anybody know what the conclusion of the cases of deaths of Mr Galbraith on the A8000 and Mr Churcher nr Roslin were? Can FOI be used for Police or CPS?

    I can't find any details from a quick skim, but will this not be five years for attempting to pervert the course of justice, with a bit of time for the collision itself running concurrently?

  7. None of the reports say, though the tariff that's possible for causing death by dangerous driving is 14 years; perverting the course of justice is a common law, rather than statutory, offence, and so technically doesn't have a maximum, but prosecution guidelines are up to 3 years.

    This being the case it's slightly more likely that the causing death aspect is seen as a more serious offence, so the 5 years will be for that, with a small amount for the perversion running concurrently.
