    The difference between 100 and 150 pounds doesn't seem like it would have a great effect.

    There didn't seem to be anywhere to suggest confiscating their phone...

    I suggested greater enforcement might be the main thing

    Sally, I did likewise. If the current bpenalty was enforced it would eradicate the problem. I also suggested they look at the possibility of allowing fpns based on civilian witnesses.

    Seems like a consensus here. I also suggested better enforcement because I believe the current penalties should be sufficient, it's just that the chances of getting caught are so small.

    Have completed the survey. Feel very strongly about this. Making mobile phone companies repsonsible is a bit like makuing pub landlords/restaurants responsible for preventing drink driving- ridiculous...

    Afraid the only way I can see around this one is the (very big) stick approach rather than carrot...

    Eddie, yes probably best so that two miscreants can't point the finger at an innocent, although phone records should be sufficient to prove innocence in that situation.

    This thread has prompted an off-forum discussion... does anyone know why there is a specific law for mobile phone use at the wheel i.e. why it isn't covered by careless driving?

    Also gov.uk says that "You can use hands-free phones, sat navs and 2-way radios when you're driving or riding", but what if you are using a push-to-talk radio app on your phone. The distinction seems a bit artificial (since you could argue a phone is a two-way radio anyway).

    Surely using existing careless driving regs would be better as it wouldn't have to be so specific (and therefore loopholey).

    Can they give out a fixed penalty for careless driving or would it have to go to court? Much easier for the police to see the phone in the driver's hand and fine them on the spot, than have to prove they were risking the control of their vehicle through careless driving.

    In the dark of winter as you crawl around the bypass in your automobile you can see the wan glow of Facebook stacked up in front of you. To be fair, some do seem to be doing work e-mails.
