Sanctimonious cyclist

    Yesterday got told off by a cyclist for having a word with a BMW driver stopped in the ASL, texting who had nudged my back wheel and given me the finger for complaining. The cyclist hadn't seen any of this just heard me taking loudly to the driver ....and told me 'i gave cyclists a bad name' and i should remain calm. He said I 'shouldn't be a vigilante '.... I should 'record and report' I said that it was often better to have a word as reporting it was a total waste of time. Anyway i cycled off with him still telling me i was a vigilante.... . he told me he been cycling everyday for 20 years ....which really wasn't an advert for daily cycling, He turned into some offices in Morrison St.

    Checked my headcam footage afterwards .... the bloke was even more annoying on the replay.

    I've pretty much completely given up reporting anything to the police - it's so rare that they actually do anything that I feel bad for wasting their time. I've had two convictions with my camera footage - one was because the guy assaulted me (spat in my face) and one was because I took my camera off to hold 3 inches from his face to get a clear picture of the phone he was using.

    Hmm, interesting. I wonder what GDPR implications there are now of collecting personally identifying biometric data without consent and posting it on YouTube?

    (Haven't watched video, so no comment on the content, or wrongdoing etc)

    I won't speak to the police since my accident where the driver got off and i faced criminal charges.

    Since then I've filmed a private coach driver running into me deliberately ..he was illegally in the bus lane ...my bike was stuck under his bus.. i call police ....while waiting the driver gets out and assaults me and his accompanying tour guide manhandles witness... police arrive go and speak to bus driver and then come out and harass me for shouting at bus driver. I said 'i called you' my cycle is under his bus, he's assaulted me and hes in a bus lane ...i called for a supervisor... traffic police arrive ...check my video ...charge the driver with careless driving and assault... asked me if i would like to make a formal complaint against the original attending officers (i didnt).. ...haven't heard a thing since and that was 9 months ago... so I assume assault and deliberately driving at cyclists is ok.. That said i find talking to drivers is really effective now. My usual line is " you do know its an offence to text and drive? Do you have family? Well if thats a yes and your children get hit by a driver texting, drinking or speeding ... then dont blame that driver ...blame yourself because you are the problem. Then ask them to put it away and say will you do it again? Surprisingly many say no.

    Indeed, yes consent is required, and worth noting that it’s the ‘domain’ which would be liable for any infringement, so in this case ‘cce’ could be liable if there were a complaint, as much as (likely more so) the videographer themselves as cce is responsible for the content on this site.

    There’s not much on YouTube about this because Google knows they’re on shaky ground regarding GDPR.

    It's important to remember that consent is only one of several acceptable reasons to process personal data under GDPR. CCE could perhaps be considered to have a legitimate business reason to process information about drivers who pose a threat to cyclists.

    I also don't know and don't have time to check if a link to another site would be considered processing data. Perhaps embedding the video would be though.

    There's certainly some provision for processing data which is in the public interest, which would justify the recording of images of driving offences being committed.

    When it comes to publishing, that's a bit more of a grey area just now.

    An interesting note on the ICO website about not uploading photos/videos [with personal data] to the internet in general. https://ico.org.uk/for-organisations/guide-to-data-protection/encryption/scenarios/photography-and-video-equipment/

    I still think the 'public interest - offence in progress' justification will offer a good deal of protection but things have definitely changed for headcam/dashcam users and some caution is probably advised for a wee while on the publishing front.

    Now, how do the TV guys do that clever masking of people's faces in a moving image?

    @Ragingbike - I find it upsetting that someone who must in theory know the risks that cars pose, can take the contrary view that you are giving cyclists a bad name. Even if he feels directly confronting drivers is ill-advised, unless he knows the specifics of the situation his response is prejudicial.

    If you are to take responsibility for a group of people who travel a certain way, then surely he is, and I would put it to him that he is making us all look like judgemental eejits.

    I wonder what his response to you would be if he actually knew what you'd been through.
