"Nesting season" and obstructions?

    I've now moved out to Broxburn but I still pop back into Edinburgh fairly regularly and my current favourite route is along to the tram at Ingliston and then into town on that. Unfortunately the shared use path along Glasgow Road is at several points basically overgrown with branches hanging so low over the path I have to hunch down level with the handlebars to get under them and that's only going to get worse as the summer goes on.

    The only response I can get out of either council however when I try to chase up reports is a verbal shrug of "nesting season innit, sorry". "Nesting season" is from March to sodding September, are they seriously going to refuse to keep the path clear for half of the year? And if so, is it unlawful for me to grab my own garden tools and just clear it back myself? My understanding is it's only a problem from a wildlife protection standpoint if you knowingly damage a nest(and birds are hardly likely to be nesting right in the last few feet of branches overhanging a path), but trying to fine or prosecute someone for showing up their laziness is exactly the kind of petty BS I can see a council official wasting taxes on.

    Nesting season isn't stopping the council from pruning lower hanging branches around East Craigs this week.

    It would seem relevant bit of path and EC are both in https://www.edinburgh.gov.uk/main-offices/north-west-locality-1

    Perhaps they can help.

    You'd think that there would be an exception for keeping roads and paths clear on a safety standpoint. In the old days, I used to cut quite a lot of stuff back, NEPN, canal, WoL all through nesting season with zero issues. You need to be discriminate and check for nests but in my experience the new growth encroaching on paths is just thin green stuff that birds don't nest in.

    Actually using your brain and checking for things is something sadly missing from today’s council and utilities workers
