I saw a post from Cycle Law Scotland. THey we’re representing a cyclist taken out by another cyclist at intersection of NCN75 and NCN7 - Black Cart Water Renfrewshire. Way

    Both cyclists were tanking it

And the ruling seems to be

We should all look out for each other instead of behaving like dicks.

Anyone else see this or did I dream it?

    I saw it

    Not sure where

    Quite a good summary for a dream…

Think it was a while ago

I remember reading the judgement, I recall the learned and no doubt non-cycling judge had pretty unreasonably low ideas of ‘safe’ speeds on bike paths (ie much less than the suggested(?) 15mph)

‘Mr Franklin had an undisputed expertise and his impartial evidence had not been contradicted. The crucial element of his evidence concerned the safe speed at which the parties could have approached the Y-junction, namely 10mph for Mr Merrick and 7mph for Mr Dick. All the evidence of speed suggested on a balance of probabilities that the approach speed of both parties was substantially in excess of the safe speed. If so, then both parties were in breach of their respective duties to take reasonable care.’

Oddly enough Mr Vehicular Cycling appears to have thought bikes weren’t like cars when he was on pay…
