Advice: Cyclist Hit By Car

  1. Not me, but a guy I know, hit by a car at the weekend - up onto the bonnet, but fortunately just a few bumps and grazes. Bike looks like having a knackered form and brake at the least. Police attended, agreed driver was at fault. Driver currently helpful and wants to pay for damage to bike. Started to feel stiff in neck and upper arms the day after. Asked for advice on next steps. My advice was:

    1. Contact your GP and get properly checked over (he's doing this)

    2. Make sure you get the police incident number.

    3. Possibly contact one of the cycle specific lawyers (don't think he's a CTC member) in case the driver baulks at damage payment later on.

    Have just thought of '4' to go to the local bike shop and get the bike checked over and have the repairs priced properly. Anything else? (I offered to contact a cycling hive-mind on what to do and he's happy with me doing that).

    Make sure they go through insurance.

    When I had my bump I was happy to just let the driver pay for the damage, which she did without question.
    Only problem was the bike hadn't been properly checked out, and the rear mech doesn't function exactly as it should. The bike shop basically said it would be fine but needed some tweeking which they did, the essentially got it kind of working.

    So I found myself in the position that she has paid for the damage as per the original bike report and the rear mech has had a hash job done on it. The shop said go back to her and get more money for the mech, but I feel I can't go back to her and say sorry, need more. So I have to either make do with not quite right shifting, or shell out for a new mech.

    If I had gone through her insurance they could have argued the toss with the bike shop, I would have got the bike fixed properly, and she would have been none the wiser and therefor not potentially offended by some potential chancer trying to get more money from her....
