12 months jail - 2 years ban for killing cyclist

    Interesting that he had previous convictions for
    " defective tyres and using a mobile phone while driving"
    and
    " previous convictions also include five times driving while disqualified and uninsured"

    having a defective car and also hitting and killing a cyclist...

    But it's ok because
    "he was said to be a hard working man who had brought up a family and raised money for charities .

    “He is remorseful and if he could put back the clock, he would,”

    Not sure how I feel about this one. I don't think he set out to kill anyone and he had previous which is reflected in the fact that he got a custodial sentence. But CLEARLY he should never be behind a wheel again...

    Then again, he did get a ban. Contrast this to 2009 when Mr Underdown lost control, ran two people down & got off scot-free
    Perhaps the tide is turning gradually.

    Still should be a lifetime ban. Until then there will be little change in attitude.

    Interesting - found this article on road CC which is fairly relevant. http://road.cc/content/forum/110081-meet-jury

    Mostly about how the CPS won't go for bigger bans because it would likely goto jury and not get a conviction.

    The tide is not turning. There are endless examples of why not. Here is a case from last week which was pretty much identical only the driver got off completely free.

    He only got that punishment for having been a naughty boy previously, lets face it.

    That road cc article is right on the ball. Too many people want cyclists dead.

    Examples and counter-examples, hard to detect a trend without a statistical study.
    I guess the unseen punishment is whether the offender can ever get insurance again once eligible for a licence. Chances are that it will be thousands per annum, especially if their old insurance had to give a big payout. An economic ban from driving again for 5 years effectively.
    Not suggesting that a lengthy ban and re-sitting the test are redundant, clearly not.

    I am not sure how that is a counter example? His friends were in another car, not riding bikes.

    I would hope that the insurance would prevent people from driving again but it probably just results in them driving without insurance. It's what the guy in the opening post did.

    Not much better in the US. Man falls asleep at the wheel, kills cyclist, and manages to blame new car smell. Misdemeanour - not felony...
