    Hope you're feeling a bit better. My non-legal view is that your claim should be for reinstatement of everything damaged to its prior condition whether through repair or replacement. Well, apart from your skin, of course.

    Ouch, that certainly takes the fun out of riding through puddles. I hope the mental picture of your forks heals in time for you to be pronounced fit to ride again.

    Snowy, I'm quite suprised to see Maybury road listed as one of the worst in 2012-13. It may have the occasional pothole but is far from the worst in the area, nevermind the city. Maybury Drive was awful at the time though so I wonder if it was a typo.

    Silversands, Aberdour pothole was made safe 'as an emergency' this morning, after my prodding the Council to see what was happening on Friday.

    Have you established who owns road/responsible for upkeep?

    Fife Council is responsible for the upkeep. They are sending out a "third party" claim form.

    Today's rain allowed me to get a picture of the road as I encountered it on the night.

    The whole route isn't great tbh, as you descend a short but really steep tree lined hill which is always dark, dodging a lot of small pot holes, then meet a left bend which is the entrance to a car park, so you have to ensure there are no cars, and then have to negotiate the speed bump on the right hand side, and then you are on that section.

    All of that dodging, then car park, then speed bump in less than 5s, when you look forward again you are on this....

    This is the main Route 76 cycle route!

    The only other alternative route from Aberdour to Burntisland is over 'the hill' on the A921 which is full of blind corners.

    The multi potholed surface at the Princes/Leith St's/Waterloo/NB junction is now being repaired.

    Long overdue, but welcome nonetheless.

    Beware of the split level rough surface if you are heading over there in the dark the next week or so. Not all the bits under repair are roped off!

  8. Yep - from the top deck of the 22 bus pre-7am yesterday morning I saw a motorbike rider get the fright of his life as he dropped into the gouged-out area and then battered back up the other side, causing a big wobble.

    Imagine it'd be even worse to get the same nasty surprise on a bike.

    It stops just a bit too far east to completely replace the carved/rutted bit westbound in front of the Balmoral.

    Emailed Council after they didn't respond to foi request, and they have fobbed me off with a 'technical exeption', another 20 days to wait..

    Have questioned them as looking at the exeption 'the enviroment' appears to be the natural one, and not physical, sigh.

    "The information you have requested is subject to the Environmental Information (Scotland) Regulations 2004, therefore, requires us under Freedom of Information Act 2002 to apply exemption S39 (2)(a) Health, Safety and the Environment, as the information is obliged by regulations under S62 to make available to the public in accordance with the regulation.

    We will continue to proceed with your request under the Environmental Information (Scotland) Regulations 2004, which allows us 20 working days from the date after receipt of your original request."

    Indeed, but they seem to have ignored the original (now) 23 days old request, and started afresh from today. Time stamped todays date on the 'new' Environmental Information request.

    Yes, thers's nice new tarmac there, but there's a pothole just past it, in the turning line from Princes St to North Bridge. Clarenced.

    For "bus wheels" read "excavator".

    I thought that this was only allowed if clarification of the original request was needed before the request could be actioned. CEC should not be able to take 20 working days to decide whether or not to apply the Environmental Information criteria, and then start the clock ticking from that point on.

    Came off my bike last night on Colinton Road (just down from Craiglockart Park Junc). Broken collarbone but other damage saved by helmet. I just could not see it in the dark. Going to claim. Watch out for those ones.

    Sorry to hear that kdstephen. Nasty injury and hope you make full recovery.

    That's a fast bit of road on a bike and you're right about some of the obstacles - join in surface in one place is a danger to narrow tyres.

    Let us know how your get on with claim.

    kdstephen, thats a sore one, get well soon.

    I am trying to take it easy at the moment as the leaf sludge is covering all manner of potholes and an off might be disastrous for my (already knackered) hips.

    I think Bikeability Edinburgh had an 'off' in Holyrood Park the other day as well, but not sure if it was pothole or leaf sludge related?

  23. Much empathy @kdstephen Hope you recover fully and quickly, and good luck with your claim

    I still have no recollection whatsoever of my crash. A complete loss of half an hour!

    Thankful for my helmet too. For doing its job so well, I'm replacing it!

    Reply from Fife council on my FOI come 'Enviromental' request which is pretty surprising.

    Firstly the road is not adopted, but is maintained by the Council. I don't know if that makes my case more difficult to pursue (I haven't claimed yet as was waiting for info).

    What I found astounding though is the following:
    "
    · Dates of all safety inspections undertaken on the carriageway in the two years preceding todays date (6th Oct 2015).

    No safety inspections are done on this stretch of road, if there is a problem normally the groundsman would report it to the area officer for this area

    · Details of all carriageway defects identified during safety inspections in the two years preceding todays date (6th Oct 2015)

    Pot holes on this road have been filled in the past 2 years

    · Details of how carriageway safety inspections are undertaken, including whether walked or driven, the speed of the inspection vehicle and the number of persons in the vehicle.

    No safety inspections are undertaken
    "

    Can I just clarify that this stretch of road which is one of the main cycle routes in Fife (Route 76), and is also used by 1000's of pedestrians every year to access one of Scotland's busies beaches, and one of Fife's most prestigous tourist areas is not formally inspected for potentially dangerous defects?
