  1. From Road Share (with links to Cycle Law), featuring Mark Beaumont, and a heartfelt message from Frances Darling, whose sister was killed while cycling.

    Vested interest that I produced the initial edit of the video, but also something I fully believe in being something that can help (in conjunction with lots more).

    Well done WC and all involved producing the video. Shame on Derek Mackay who said he would only consider this even if it would make active travel safer. (a couple of words added by me for emphasis).

    Any driver worried about being held wrongly responsible could easily use data recorders and cameras which would help show whether or not they had been driving badly and what other parties had done.

    I don't understand the current focus on presumed liability campaigning. Why not throw all your weight behind measures to stop people needing compensation in the first place?

  4. Because you'll never completely eliminate incidents (unless every single road in the entire country has segregated cycleways?)

    And the world ain't black and white - just because you campaign for presumed liability doesn't mean you can't campaign for other things - it's not like, say, Pedal for Parliament will be out with a clipboard next year and checking off names with, "Oh hang on, you've been campaigning about presumed liability haven't you? Ah well, sorry, you're not allowed to ask for segregated cycleways..."

    To me, presumed liability, while positive in itself, looks like a dead end. It won't make future cycling investment easier. It might even make it harder if viewed by the general public as 'us' blaming 'them'.

    While we can campaign for as many different things as we like, only so much can be delivered with the resources available (financial/political). I'd much rather see changes which advance safer cycling by creating more cyclists, e.g. change planning regs so new developments have to provide links to existing cycle routes (subsidise it even).

    Eob, I think presumed liability will make cycling safer. I drivers are aware that evidence of an incident is sufficient to apportion liability they will on the whole be more careful. Part of the pressure will.of course need to come from insurers but I don't imagine it would take too many instances of insurers reclaiming costs from reckless drivers to start changing behaviour. Currently insurers seem happy to pay out regardless of laws being broken.
