Another cyclist killer walks free

    "A DRIVER who failed to stop after a crash that left a cyclist dead smiled as he walked free from a court.

    Michael O’Shea, of Roman Way, Andover, made obscene gestures to reporters as he left Basingstoke Magistrates’ Court last week."

    5 month suspended sentence and a 12 month (!) driving ban.

    Killing a cyclist is like accidentally running over someone's dog.

    Not good reading if you cycle in Andover, or anywhere else.

    Can't understand how this could be considered a just result.

    These English judges Magistrates are laymen, if look at the guidance on sentencing could see if fits, however it seems to have missed the leaving the scene and nor coming forward, would be surprised if that offense could not have been added, nor if leaving the scene could be considered adverse inference by failing to provide breath or drugs testing. Also who knows may be the cyclist could have lived if had raised alarm quicker. The hit and run and failing to stop failing to provide sample or report to police station. Always wonder if the English system using laymen if robust when the rest of Europe uses professionals, including Scotland, although in Scotland a private prosecution could not be taken (unlikely to be as need permission only 1 in 100 years or something) such as that other case discussed recently.

    Ed1 Failing to stop was the only thing he was charged with. Reading between the lines, police and CPS probably couldn't find, or didn't look hard enough for, evidence of careless or dangerous driving or causing death by same.

    The massive increase in physical power that getting behind the wheel confers seems similarly to boost egos. People feel impregnable in their cars, more in control, oblivious to the fact that these are machines that deliver injury and death every day. Sometimes people feel intensely that their car is a totally private space, a tiny peripatetic kingdom over which they rule.
