    The Data Protection Act relates to personal data and sensitive personal data, that identifies or is likely to identify an individual. While that might include things like date of birth or your housing records or your name and address, it also includes CCTV footage.

    Where is the line between filming in public and CCTV?

    Presumably someone's personal name that for business purposes is publically displayed on the side of a white van cannot be classed as personal information because it has been made public by the owner.

    To add to Arellcat's definition, it also includes data that can be used in conjunction with other information about the individual to identify them. For example, a video of a car could be argued to be personal data if someone was already in possession of a database linking numberplates to people. From the stuff I've read (I have some involvement from a work background as well) there's no blanket guidance that will apply.

    This morning, a car turned right from Russell Road. I let him across in front of me as the lights were red. He then proceeded to creep over the stop line, then turn left through the red.

    A black Audi estate car was doing maybe 70-80mph going north on Mayfield Road at lunchtime today.

    Small Peugeot attempting to exit Manse Road onto St. Johns Road against the one-way system this morning. Driver's difficulty in moving against the not insignificant flow of traffic going the other way was compounded by a smashed passenger-side front window that had been taped up with non-transparent plastic sheeting.

    Just because it is personal data doesn't mean that you cant record it and process it lawfully. I don't see that the purpose that you gained this information ( to show who the idiot driving a vehicle dangerously was, to shame them or report to the police) is incompatible with any of the principles, other than perhaps 8 if Google host You Tube content outside of the EU.

    Ford Ka which sat in the ASZ at the end of Morrison Street. Traffic had been held up for a tram coming from Haymarket and another was coming from town. He decided he'd had enough and went through the red light anyway.

    yesterday rather than today, but the driver of [somebody or other] [some trade or another] van which turned right onto Roseburn Place from Roseburn Dr heading towards Russel Rd direction without looking like he was going to stop for me.

    In fact he exited Roseburn Pl without looking at all.

    And then *immediately* stopped to double park and block the way ahead for myself, another cyclist and a couple of cars. Even stuff coming the other way was struggling slightly to squeeze through the gap.

    He had his hazards on though, so I gather from the Highway Code (common sense version) that this should really be in the 'good driving' thread, or something.

    Lost count of the double parked vehicles blocking the cycle lane/parked in bus stops/parked in disabled bay without blue badge/etc on Leith Walk today too.

    Two eedjits in the four minute ride from office to station in Linlithgow. Eedjit the first, close (almost deliberately threatening) overtake on an otherwise empty road - from a car with NL plates. Eedjit the second, entering the roundabout without looking for other vehicles (me) already on the roundabout. The shock on the driver's face when I shouted "LOOK!".

    I know that if I sign up for the Near Miss Project these will evaporate. Can I use that as a talisman for safe riding?

    A Lothian #33 (possibly number 733, but it's all on camera and will be getting emailed to them this evening) started signalling left to move from the inner/tram lane on Princes Street westbound, but then started moving left anyway even though there was clearly a cyclist on their left going at their speed, who had to escape to the rear. The #33 then proceeded to not stop at the next stop anyway.

    There were two vehicles 'caught' beyond their stop line turning right from Macdonald Road into Leith Walk this morning when the north/south lights went green. The first, a van or truck, went through without any problem as it was blocking the northbound lane. The second, a Beemer, dithered somewhat, but then went through anyway, as any sensible road user with experience of Beemers' drivers would have anticipated, but the driver of the southbound car on my left still though it surprising enough to be worth beeping. Minus two points to both.

    Today's inconsiderate driving was by SP12 VTL at the Braid Road Crossroads. I'd patiently waited at the Stop for going straight ahead whilst those turing right on the Give Way had priority only for this prize prune who wasn't signalling and was positioned for either going straight ahead (or even left they were so far to the left) to decide as I started off that they would indeed turn right... and did so, putting their indicator on part way over to make it OK. The Three Stooges occupants of the van appeared to think I was in the wrong. Unfortunately no apparent trade name on the van.

    I've twice in the past week had drivers cut me up in order to then pull over at the kerb. How can you be so impatient to stop that you can't even roll in behind a cyclist?

    Oh and given that the traffic seems to be particularly snarled up today JM Builders seem to think it's fine to drive whilst holding and talking on their phone... have experienced bad driving from them before both as a car driver... and a bus *PASSENGER*!

    Any other Leith Walk users (northbound) noticed that the plastic fencing outside the building site has slowly been encroaching further and further on the kerbside lane? You get about halfway along and the lane turns into half a lane turns into just enough space for a cycle to fit through.

    Streetview shows a wavy but basically straight line where now it skews right out into the road.

    @dougal, yes I have. Can do with as much room as possible given the state of the road surface there, not made any better by the lorries no doubt.

  20. Hackney Taxi, in a New York style yellow livery on Broomhouse Road this morning.

    Driving whilst reading from and marking a document on his red clipboard. Yup, one hand holding the clipboard, one hand holding the pen. And yes, he was just passing the two schools.

    I should probably tweet Police Scotland that one rather than email the cab office

    Regular viewers may recall me mentioning a run-in I had last week with a council truck. Well, I decided to report it to the council, I'll paraphrase the ensuing email conversation here:

    Me: Your truck nearly ran me over. Either they didn't see me or weren't aware of how close they were, either way, given the conditions (bright day, wide road, not busy) this is pretty poor driving.

    Council: We've spoken to the driver and their passenger, they have no recollection of close passing a bike. They are qualified HGV drivers, so no action will be taken.

    Me: Well obviously they have no recollection of close passing me, that's exactly my point. If they had been aware of me, one presumes they wouldn't have done it!

    Council: Yes, well, they don't recall close passing a bike. But we did ask them about it, so hopefully that will "reinforce their awareness of cyclists". So let's just leave it at that, eh?

    You'd think after a council lorry in the next city over killing 6 people less than a year ago, and the recent revelations surrounding that incident, they might be a teensy bit less complacent...

    fwiw, I had a close pass from a council lorry when I was heading along The Shore signalling to turn right onto Sandport Place (I think - the bridge over the water where you go to join the WoL path).

    Best part was when I had to slow down because the lorry ended up blocking my way.

    Thanks for the suggestion, SPSO may be worth considering, but TBH I'm feeling pretty defeated about it all.

    Understandable.

    But I think you have cause to contact SPSO.

    Unlikely to change your outcome, but they might ask CEC to be less complacent and consider improved training.

    I'd kind of hoped that towing a fluorescent trailer containing 2 toddlers would calm people down somewhat.
    But it only seems to reinforce the Must. Get. Passed. mentality and this type of maneuver happens with depressing regularity.

    At the traffic lights outside Playhouse going uphill I was stopped in the left lane and another cyclist was stopped in the right lane. So the driver who Must Get In Front ran the light by squeezing between us. Of course I pulled up next to him at the lights outside Baillie Gifford.

    Distance gained: 0.
