"I didn't realise"

    There have been a few stories posted here where the Police have apparently tried to excuse drivers running people down and driving away on the grounds that they may not have realised what happened.

    I propose a little competition to see if we can find the most bizarre incidence of this. Well I would only I think I have found the winner already.

    Motorist hits 8 years old girl, shouts at her for damaging his car and drives away.

    Guess what?

    Drum roll

    "Police say he may not have realised what happened."

  2. I can actually, bizarrely, almost see the logic in that. He thought one of the kids had deliberately hit his car (with something or a fist or thrown stones).

    So he may not have realised he was the one who actually hit the kid, rather than the police thinking he might not having realised at all that he hit someone.

    I'll bet he was listening to an illegally recorded CD at the time though.

    I wonder if the destruction of our creative industries has led to more suicides (or less directly-linked deaths) than hit and run drivers have?

    Obviously he realised he hit someone but "may not have realised" that he was driving so close to a child that he hit her in the face. Really? :-/

    I'm not saying that it exonerates him! But yeah, it's possible (and therefore dangerous driving) that he was driving so badly, and without paying attention, then heard the bang and put 2 an d2 together to come up with 5.

    Equally the story says nothing about exactly where on the road etc this all took place. He'd have to be driving virtually along the kerb, with the girl virtually along the kerb (and ducking if it's a 'standard' car) to hit her in such a way.

    Devil's Advocate.. Group of kids messing about, I'm sure we've all seen it happen, one gets pushed towards the traffic as a 'joke' (usually being kept hold of). Could eaily go wrong, girl is pushed into car, stumbling, falls to the level of the wing mirror and gets smacked by it. Driver has been driving along the road, not expecting (again, quite poor when there's a group of kids on the pavement) anything untoward might happen - here's the bang, thinks something has been thrown at the car. Hence the remonstrating.

    It's the remonstration that gets me. I mean, I've been shouted at by someone clearly covering up that they were in the wrong. But actually stopping and remonstrating with the kids, shouting at them that they had hit his car, does seem to me to be the act of someone who hadn't realised what had happened (whether that was down to his actions or those of the kids).

    In short (thankfully!) there's actually too little detail in the article to be able to tell...

    I said not so long ago that a defence to running someone down should be to plead "actual bodily harm through negligence" which would carry the same sentence. At least it gives people the choice, negligent or deliberate, and society condones neither.

    Anth - Of course everything you suggested is plausible but to me, whatever happened the driver has already been given a get-out clause, akin to "I didn't see you".

    "Oh of course I didn't realise officer"

    "Of course you didn't. Run along now"
